According to the Decree of the President of Azerbaijan, dated 27 January 2022, a number of amendments have been made to the Code on Administrative Offences of Azerbaijan (hereinafter referred to as the "Code").
The relevant amendments have been introduced into Article 539 of this Code, "Failure to comply with the instructions of the respective executive authority responsible for State supervision of compliance with labor legislation".
Thus, conclusion, amendment and grounds for termination of employment contract between employer and employee, working conditions, working hours and leisure time, exercise of leave rights, wages and leave pay, business travel expenses, benefits and other payments, failure to comply with the decisions and directives of the relevant executive authority on compliance by women and workers under the age of 18 years on requirements for the use of labor shall be subject to a penalty of AZN 1,000 for officials or AZN 2,000 for legal persons.
In addition, a "Note" section has been added to Article 539 of the Code.
Administrative liability under the above provision is incurred only if the above actions do not entail administrative liability in cases provided for by Article 192 of this Code "violation of labor legislation".
